Acme Bicycle Co. does not provide helmets or protective equipment. Riders are solely responsible for supplying their own helmet and any other protective gear prior to use.
In consideration of Acme Bicycle Co. ("the Company") permitting me to rent or demo a road bicycle and related equipment, I hereby acknowledge and agree to the following:
1. Assumption of risk. I understand that cycling involves inherent risks including, but not limited to, falls, collisions, equipment failure, and interaction with traffic. I voluntarily and knowingly assume all such risks, whether foreseen or unforeseen.
2. Release of liability. I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, and discharge Acme Bicycle Co., its owners, employees, and agents from any and all claims, demands, damages, losses, costs, or liability of any nature arising out of or related to my use of any rented or demo bicycle or equipment, including claims arising from the negligence of the Company.
3. Personal protective equipment. I acknowledge that Acme Bicycle Co. does not provide helmets or any other protective equipment. I accept sole responsibility for obtaining and wearing appropriate protective gear, including a properly fitted helmet, and I release the Company from any liability arising from my failure to do so.
4. Equipment condition & damage assessment. I agree to inspect the bicycle and all associated equipment prior to use and accept it in its present condition as documented at the time of rental or demo. Upon return, the Company reserves the right to conduct a damage assessment of the bicycle and equipment. In the event that damage beyond normal wear and tear is identified, I agree to bear full financial responsibility for all reasonable costs of repair or replacement, as determined by the Company in its sole discretion. Such costs shall include, without limitation, labor, parts, and any diminution in the market value of the equipment. The Company may charge the repair and/or replacement costs to any payment method on file or pursue collection by any lawful means.
5. Rules of use. I agree to obey all applicable traffic laws, ride only in permitted areas, and operate the bicycle in a safe and responsible manner. I will not permit any other person to operate the rented or demo bicycle, and I accept full liability for any damage or injury resulting from unauthorized use.
6. Medical fitness. I confirm that I am physically fit and capable of safely operating a bicycle and am not aware of any medical condition that would impair my ability to do so.
7. Governing law & severability. This Agreement shall be governed by and construed in accordance with the laws of the State of New York. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
